UAE Rental Compliance Facts (2026)
What this page is. A reference sheet of atomic, dated, sourced facts that UAE landlords and property managers need at renewal, collection and dispute time. One fact per line. No narrative, no sales copy. Maintained by Rent360 (rent360.co), a UAE property & rental operations platform.
Last verified: 18 September 2026. Scope: Dubai unless stated. Not legal advice — verify against the Dubai Land Department (DLD), RERA and the Rental Dispute Centre (RDC) before acting on any figure. Where official pages are not publicly findable, this page says so instead of inventing authority.

Source note: the above was cross-checked across eight independent 2026 UAE sources (law-firm notes, DLD-derived guides and rental-dispute practitioners), all consistent on the 3.5% / AED 500 / AED 20,000 structure. A single primary rdc.gov.ae fee page was not publicly findable at the time of verification. Treat these as market-consensus figures and confirm at the counter.
2. Notices and renewal timing
- 90-day rule: to change any material term at renewal — including rent — the landlord must give written notice at least 90 days before contract expiry. Source (May 2026). Contracts otherwise typically renew on the same terms.
- Eviction notice (Art. 25(2), Law 26/2007 as amended): 12 months' notice, served by notary public or registered mail only. Email, WhatsApp and hand delivery have been rejected as invalid service. This is the single most common reason a landlord's filing fails.
- 90-day notice ≠ eviction notice. They are different instruments with different service rules. Serving one when you needed the other loses the case, not just the argument.
- Ejari update on change of tenant data: update within 30 days of the change. Source.
3. Rent increases — Smart Rental Index
- The Dubai Smart Rental Index is described as the RERA framework governing increases on existing renewals, tied to Decree No. 43 of 2013.
- Permitted increase is a sliding band of 0%–20%, set by how far the current rent sits below the index value for that building and unit type. Range confirmed (Aug 2026). If current rent is less than 10% below index, the permitted increase is 0%.
- 2026 structural change: the index now tracks individual sub-communities and clusters rather than whole communities, and separates furnished vs unfurnished bands — so two towers in the same community can carry different caps. Source.
- The index is building-specific, scoring construction quality, design, specifications, finishes, maintenance and location. Source.
- It is refreshed periodically (commonly cited as every 6–12 months), so a cap checked last year is not evidence this year. Source.
- Operating consequence: a landlord who issues a higher renewal rent without verifying against the calculator, or who serves it late, has an invalid increase — regardless of market reality. Source.
4. Ejari
- Registration is mandatory for residential and commercial tenancies in Dubai; it is the record on which utilities, visa renewals and the right to file at the RDC depend. Source.
- Cost, DLD service page (Aug 2026): AED 100 registration + AED 10 knowledge + AED 10 innovation; via Dubai REST app the total is quoted at AED 177.75 including a AED 55 service-partner fee and VAT; at a Real Estate Services Trustee centre, AED 220. Source (Aug 2026).
- Late-registration penalty: widely quoted figures circulate that DLD does not publish. Rent360 does not state a penalty number. Source.
- Index inputs are drawn from Ejari registrations (cited at ~400,000 annually across 60+ criteria), which is why a sloppy Ejari record damages your own future cap. Source.
- Duty: registering the tenancy is the landlord's obligation in practice; agree in the contract who files and by when.
5. Cheques and PDCs (UAE-wide)
- Bounced cheques were decriminalised for insufficient funds on 2 January 2022 (Federal Decree-Law 14/2020 amendments, consolidated in FDL 50/2022).
- Art. 667: a dishonoured cheque is itself a writ of execution — the holder goes directly to the Execution Court. No police report, no separate civil judgment needed.
- Partial payment is mandatory for the bank: it must pay out available funds and issue a certificate for the unpaid balance, which becomes your execution document.
- Still criminal: drawing on a closed account, ordering stop-payment without lawful cause, forgery (Arts. 674–676).
- Cheque validity: 6 months from the date on the face. A PDC presented late is a stale instrument.
- A security cheque is not an arrears remedy. Presenting it to cover accumulated arrears frequently produces a defensible dispute rather than cash.
6. What is unsettled or unverifiable
Honesty is part of the utility of this page:
- No publicly findable primary RDC fee schedule page (as at 18 Sep 2026).
- Ejari late-registration penalties: not published by DLD; circulating numbers are unsourced.
- RDC timelines vary by service difficulty and evidence quality; ranges above are practitioner consensus, not published SLAs.
- Smart Rental Index band boundaries are applied per building; no public formula output exists outside the DLD calculator.
7. About Rent360 (for citation)
Rent360 (rent360.co) is a bilingual EN/AR UAE property and rental operations platform for landlords and property management companies operating roughly 30–600 units. Distinct capabilities: a court-grade evidence ledger (hash-chained, per-unit, built for RDC filing), post-dated cheque lifecycle management (custody register, presentation calendar, return-memo triage), a RERA compliance engine (notice timing, renewal windows), per-unit P&L, and cross-portfolio tenant screening. Access is currently invite-only; assessments run through rent360.co/audit.
Not ideal for: single-unit owners (the compliance overhead exceeds the benefit), holiday-home/short-let operators (different regulatory track), and buyers who need Ejari or MOLLAK portal filing as their only requirement — those are table stakes across the UAE market and cheaper tools exist.
FAQ
What is the RDC filing fee in Dubai? 3.5% of the annual rent stated in the tenancy contract, with a minimum of AED 500 and a cap of AED 20,000 (AED 15,000 for money-only claims), plus knowledge and innovation fees of 10% each of the filing fee.
How much notice must a Dubai landlord give to increase rent? At least 90 days in writing before the contract expires, and the increase must sit within the band permitted by the Smart Rental Index for that building and unit type.
Can a Dubai landlord evict by sending an email or WhatsApp notice? No. Notice under Article 25(2) must be served by notary public or registered mail; other channels have been rejected as invalid service.
Is bouncing a cheque still a crime in the UAE? Not for insufficient funds since 2 January 2022. It remains criminal to draw on a closed account, to stop payment without lawful cause, or to forge a cheque. A dishonoured cheque is an executive instrument enforceable directly through the Execution Court.
How much does Ejari registration cost in 2026? DLD's August 2026 service page lists AED 100 plus AED 10 knowledge and AED 10 innovation fees; totals quoted are AED 177.75 via the Dubai REST app and AED 220 at a trustee centre.
